1. Acceptance of Terms
By accessing or placing an order through Battery2Batteries.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site or place an order.
Rocket Distributing, LLC ("Company," "we," "us," or "our") reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
2. Products and Pricing
All product descriptions, specifications, and pricing on the Site are subject to change without notice. We make reasonable efforts to ensure pricing and availability accuracy but do not warrant that product descriptions, pricing, or other content on the Site is error-free. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price, whether or not the order has been confirmed.
Prices displayed do not include applicable sales tax, shipping, or handling fees unless otherwise stated. These will be calculated and displayed prior to checkout.
3. Payment Terms
3.1 Accepted Payment Methods. We accept payment via the methods displayed at checkout, which may include major credit cards, debit cards, and other payment processors as made available on the Site from time to time.
3.2 Payment Authorization. By submitting an order, you represent and warrant that you are authorized to use the payment method provided and authorize us (or our third-party payment processor) to charge the full order amount, including applicable taxes and shipping costs, to that payment method.
3.3 Order Confirmation. Receipt of an order confirmation does not constitute acceptance of an order or a guarantee that the product is in stock or available for sale. We reserve the right to accept or decline any order, in whole or in part, at our sole discretion, including due to product availability, pricing errors, or suspected fraudulent activity.
3.4 Net Terms / Business Accounts. Customers approved for net payment terms (e.g., Net 15, Net 30) are subject to separately issued credit terms. Invoices not paid within the agreed term may result in suspension of future orders until the account is brought current.
3.5 Sales Tax. We collect and remit sales tax in states where we are required to do so by law. Tax-exempt customers must provide a valid exemption certificate prior to order processing.
4. Returns, Refunds, and Warranty Claims
Most items may be returned within 14 days of delivery, subject to eligibility requirements (including that the item is unused, in original condition, and in original packaging). Special order items and custom assembled products are not eligible for return. All returns require advance authorization. Damaged, defective, or incorrect items must be reported within 5 days of delivery.

5. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Rocket Distributing, LLC, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of the Site or any products purchased through it, even if advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to these Terms or any order shall not exceed the amount paid by you for the product(s) giving rise to the claim.
Nothing in these Terms is intended to limit any rights you may have as a consumer that cannot be waived under applicable law.
6. Dispute Resolution
6.1 Informal Resolution First. Before initiating any formal dispute proceeding, you agree to first contact us at sales@battery2batteries.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute informally within thirty (30) days of receiving notice.
6.2 Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any product or service purchased through the Site that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.
6.3 Class Action Waiver. You and the Company agree that any arbitration or proceeding shall be limited to the dispute between the Company and you individually. To the fullest extent permitted by law: (a) no arbitration or proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated or litigated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
6.4 Arbitration Location. Arbitration shall take place in Volusia County, Florida, unless you and the Company agree otherwise.
6.5 Opt-Out. You may opt out of this arbitration agreement by sending written notice to sales@battery2batteries.com within thirty (30) days of first accepting these Terms. If you opt out, neither you nor the Company will be required to arbitrate disputes with the other.
7. Governing Law and Jurisdiction
These Terms, and any dispute arising out of or related to them or your use of the Site, shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
To the extent any dispute is not subject to arbitration under Section 6, or to the extent a court proceeding is otherwise permitted, you agree that the state and federal courts located in Volusia County, Florida shall have exclusive jurisdiction and venue over any such dispute, and you consent to personal jurisdiction in those courts.
8. Intellectual Property
All content on the Site, including text, graphics, logos, images, and product descriptions, is the property of Rocket Distributing, LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Site without prior written consent.
9. Limitation on Claims
Any claim or cause of action arising out of or related to your use of the Site or these Terms must be filed within one (1) year after such claim or cause of action arose, or it will be permanently barred, to the extent permitted by applicable law.
10. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.
